(Hereinafter referred to as "WIDESHOP", "we", "us", or "our")

§ 1 Scope and Definitions
 

  1. These General Terms and Conditions (hereinafter "T&Cs") govern the use of the website wideshopde.com (the "Website") and all services provided by WIDESHOP to its customers (hereinafter "Customer", "you"). WIDESHOP operates as a purchasing agent, sourcing and purchasing luxury goods from third-party retailers or boutiques in Europe on behalf of the Customer.

  2. These T&Cs apply exclusively. We do not accept any diverging terms and conditions from the Customer unless we have expressly agreed to them in writing.

  3. "Consumer" means any individual entering into a legal transaction for purposes that predominantly are outside their trade, business, or profession. "Entrepreneur" means a natural or legal person or a partnership with legal personality who or which, when entering into a legal transaction, acts in exercise of his or its trade, business, or profession.  

§ 2 Service Description – Purchasing Agency

  1. WIDESHOP provides a purchasing agency service. We act as an intermediary, purchasing specific luxury goods requested by the Customer from various third-party suppliers (e.g., official brand boutiques, authorized retailers) in Germany or other EU countries.

  2. WIDESHOP does not hold stock of the items displayed or requested unless explicitly stated. We source items based on customer requests.

  3. The service includes sourcing the requested item, purchasing it on behalf of the Customer upon agreement, quality checking (visual inspection based on standard practices), and arranging shipment to the Customer's specified address (primarily South Korea).

  4. Product availability and prices from third-party suppliers are subject to change and can only be confirmed after WIDESHOP receives the order and verifies with the supplier.

§ 3 Ordering Process and Formation of Contract

  1. The presentation of potential items on the Website or in communication does not constitute a binding offer from WIDESHOP to sell goods. It serves as an invitation for the Customer to request our purchasing agency service.

  2. The Customer submits a request via the Website, email, or other agreed communication channels, specifying the desired item(s).

  3. WIDESHOP will verify the availability and current price of the item(s) with the third-party supplier(s) and provide the Customer with a quote. This quote will typically include the estimated item price, WIDESHOP's service fee, estimated shipping costs, and any other applicable charges known at that time (excluding destination import duties/taxes).

  4. A binding contract for WIDESHOP's purchasing agency service is formed only when the Customer explicitly accepts the quote provided by WIDESHOP, and WIDESHOP confirms acceptance of the agency mandate (e.g., via email confirmation).

  5. WIDESHOP reserves the right to decline a purchasing request, for example, if the item cannot be sourced, if there are concerns about authenticity from the supplier, or due to payment issues.

§ 4 Prices, Service Fees, and Payment

  1. The total price payable by the Customer consists of: a) The actual purchase price of the item(s) from the third-party supplier. b) WIDESHOP's service fee, as indicated in the quote. c) Shipping costs to the Customer's destination. d) Optionally, costs for additional services requested by the Customer (e.g., express shipping, special packaging).

  2. All prices quoted will be in Euro (EUR) unless otherwise specified. If payments are accepted in other currencies (e.g., KRW), the exchange rate applied will be based on the rate at the time of payment processing, potentially including conversion fees.

  3. Important: The quoted price explicitly excludes any import duties, taxes (e.g., VAT, consumption tax), customs clearance fees, or other levies imposed by the destination country (South Korea). The Customer is solely responsible for these charges (see § 9).

  4. Payment is due upon acceptance of the quote and before WIDESHOP proceeds with purchasing the item(s) from the third-party supplier.

  5. Accepted payment methods will be specified during the ordering process (e.g., bank transfer, credit card via secure processor).

§ 5 Shipping and Delivery

  1. WIDESHOP arranges shipping to the address provided by the Customer. The primary shipping destination is South Korea. Shipping to other destinations may be possible upon request and agreement.

  2. Delivery times provided are estimates only and depend on the third-party supplier's processing time, shipping carrier performance, and customs clearance in the destination country. WIDESHOP is not liable for delays beyond its reasonable control.

  3. Shipping costs are borne by the Customer and will be included in the quote.

  4. The risk of accidental loss or damage to the goods passes to the Customer upon handover of the goods to the designated shipping carrier.

  5. WIDESHOP will provide tracking information when available from the carrier.

  6. The Customer is responsible for providing a complete and accurate delivery address. Costs incurred due to incorrect address information will be charged to the Customer.

§ 6 Right of Withdrawal (Widerrufsrecht) for Consumers

  1. Withdrawal from the Agency Service: You have the right to withdraw from the contract for WIDESHOP's purchasing agency service within fourteen (14) days without giving any reason. The withdrawal period will expire after 14 days from the day of the conclusion of the contract (i.e., when you accepted our quote and we confirmed the mandate). However, if you explicitly request us to begin the performance of the service (i.e., purchase the item) before the withdrawal period has expired, and acknowledge that you consequently lose your right of withdrawal upon full completion of the service, your right to withdraw from the service contract expires once we have successfully purchased the item on your behalf with your prior express consent. Our service fee may not be refundable if we have already incurred costs or performed significant parts of the service based on your request.  

  2. Returns of Goods Purchased: Since WIDESHOP acts as your agent, the possibility of returning the goods themselves depends entirely on the return policy of the original third-party supplier from whom the item was purchased.

  3. WIDESHOP will inform you of the original supplier's return policy upon request or during the quoting process if feasible.

  4. If a return is possible under the original supplier's policy, WIDESHOP will reasonably assist the Customer in facilitating the return process.

  5. However, the Customer is responsible for all costs associated with the return, including but not limited to: return shipping costs (international), any restocking fees charged by the original supplier, and any irrecoverable customs duties or taxes. WIDESHOP's service fee related to the initial purchase is generally non-refundable.

  6. Items must typically be returned in their original, unused condition with all tags, packaging, and authenticity cards intact, according to the original supplier's requirements.

  7. Exercising Withdrawal/Return: To exercise the right of withdrawal from the service (within the allowed period) or to inquire about/initiate a return of goods, you must inform us (WIDESHOP, Kölner Str. 3, 65760 Eschborn, Germany, Phone: 01788267257/01788267258) of your decision by an unequivocal statement (e.g., a letter sent by post or email). You may use the model withdrawal form below, but it is not obligatory.  

§ 7 Warranty and Liability

  1. WIDESHOP's Service: We warrant that our purchasing agency service will be performed with reasonable care and skill. Our liability relates to the performance of this agency service (e.g., diligence in ordering the correct item specified, basic visual inspection).

  2. Warranty for Goods: WIDESHOP is not the seller of the goods but acts as your agent. Therefore, statutory warranty rights for the goods themselves lie directly with the third-party supplier (original retailer/brand) from whom the item was purchased. WIDESHOP makes no warranties regarding the goods beyond those offered by the original supplier.

  3. Assistance with Warranty Claims: Should a defect covered by the original supplier's warranty arise, WIDESHOP will, upon request, provide reasonable assistance to the Customer in making a warranty claim against the original supplier. However, WIDESHOP is not responsible for the outcome of such claims, and the Customer may bear costs associated with warranty processes (e.g., shipping items back to Europe for inspection/repair).

  4. Limitation of Liability: WIDESHOP's liability for damages, regardless of the legal basis, is limited as follows: a) We are liable without limitation for damages resulting from injury to life, body, or health based on a negligent or intentional breach of duty by us or our legal representatives or vicarious agents. b) We are liable without limitation for other damages based on an intentional or grossly negligent breach of duty by us or our legal representatives or vicarious agents. c) For damages caused by simple negligence, we are liable only in case of breach of a material contractual obligation (an obligation whose fulfillment is essential for the proper execution of the contract and on whose compliance the contractual partner regularly relies and may rely); in this case, liability is limited to the typically foreseeable damage. d) Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected. e) Any further liability for damages is excluded.  

§ 8 Product Authenticity and Availability

  1. WIDESHOP arranges shipping to the address provided by the Customer. The primary shipping destination is South Korea. Shipping to other destinations may be possible upon request and agreement.

§ 9 Customs, Duties, and Taxes (Destination Country)

  1. The Customer is the importer of record in the destination country (South Korea).

  2. The Customer is solely responsible for complying with all import regulations of the destination country and for paying all applicable import duties, taxes (VAT, consumption tax, etc.), customs clearance fees, and any other charges levied upon import.

  3. These charges are not included in the price paid to WIDESHOP. They are typically assessed by the customs authorities in the destination country and collected by the shipping carrier upon delivery.

  4. WIDESHOP is not responsible for estimating or paying these charges. Customers are advised to contact their local customs office for information on potential duties and taxes before placing an order.

  5. WIDESHOP is not liable for delays caused by customs clearance processes or for packages held or confiscated by customs authorities due to non-compliance with import regulations or non-payment of duties/taxes.

§ 10 Data Protection

  1. We process customer data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR). Details regarding the collection, processing, and use of personal data can be found in our Privacy Policy, available on the Website.

§ 11 Intellectual Property

  1. All content on the Website, including text, graphics, logos, images, and software, is the property of WIDESHOP or its content suppliers and is protected by German and international copyright laws. Unauthorized use is prohibited.  

§ 12 Applicable Law and Jurisdiction

  1. These T&Cs and the contractual relationship between WIDESHOP and the Customer shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).  

  2. If the Customer is a Consumer residing within the European Union, mandatory consumer protection provisions of the country in which the Customer resides shall remain applicable, provided they offer greater protection than German law.  

  3. If the Customer is an Entrepreneur, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract shall be Eschborn or Frankfurt am Main, Germany.  

  4. For Consumers residing outside the European Union (e.g., in South Korea), German law applies as stipulated in § 12.1. The place of jurisdiction shall be determined by applicable international legal principles; however, WIDESHOP prefers jurisdiction in Eschborn/Frankfurt am Main, Germany, where legally permissible.

§ 13 Online Dispute Resolution (ODR)

  1. The European Commission provides a platform for online dispute resolution (ODR), which can be accessed at: http://ec.europa.eu/consumers/odr/.  

  2. We are not willing to participate in dispute resolution proceedings before a consumer arbitration board. 

§ 14 Final Provisions

  1. Should any provision of these T&Cs be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected.

  2. Amendments or additions to these T&Cs must be made in writing. This also applies to the waiver of this written form requirement.

  3. WIDESHOP reserves the right to amend these T&Cs at any time. The version applicable to the Customer's order is the one in effect at the time the contract was concluded.
